Tobacco giants lose fight against plain packs

TOBACCO giants lost their latest legal battle against the government’s plain-packaging rules yesterday.

The firms, which include British American Tobacco, Imperial Tobacco and Japan Tobacco International, were challenging the legality of the Standardised Packaging of Tobacco Products Regulations 2015.

The High Court rejected their challenge in May, prompting the firms to go to the Court of Appeal.

They argue the 2015 rules destroy valuable property rights and renders products indistinguishable from each other.

But three judges in London upheld the High Court’s decision.

Ash health charity head Deborah Arnott said: “This ruling should also encourage other countries to press ahead with standardised packaging now that the industry’s arguments have yet again been shown to be without foundation.”
